Preamble
The present terms and conditions of sale are concluded on the one hand by the GOLDWIN one-person liberalized simplified share company, with a capital of 1,000 euros whose head office is located at 7 rue Claude Chahu, 75116 Paris, registered on the register of Paris under the number 823 367 834, hereinafter referred to as «the Advocate» and, on the other hand, by any natural or legal person wishing to make a purchase via the Lawyer’s website, referred to herein as the «Customer».
Object of the contract
These general conditions of sale are intended to set the contractual provisions between the Lawyer and the Customer and the conditions applicable to any purchase made through the commercial site of the Lawyer, by a natural or legal person. The acquisition of a service through this site implies unreserved acceptance by the customer of these terms and conditions of sale.
Geographical area
The on-line sale of the services of the Lawyer is reserved for the clients justiciable who reside in Metropolitan France or which are subjected to the French law.
Prices
The prices appearing under the tabs «Fees» are excl tax prices in euros to which we must add the VAT up to 20% applicable to the day of the order; any change in the rate will be specified on the site as of its entry into force. The Lawyer reserves the right to modify its prices at any time, it being understood that the price appearing on the site on the day of the order will be the only one applicable to the Customer.
Orders
The customer places an order on the website “www.goldwin-avocats.com”. To purchase one or more services, it must follow the following ordering process:
– Selection of the chosen service
– Validation of the cart and summary of the order
– Validation of payment
The customer will receive an order confirmation email.
Delivery of the service.
The Lawyer reserves the right to cancel or refuse any order that emanates from a Customer with whom there is a dispute over the payment of a previous order or a conflict of interest or any other cause contrary to the deontology applicable to the profession of Lawyer. Any order implies acceptance of the amount of fees and start of performance of the service given its particularly personalized character.
The Lawyer undertakes to honor the consultation requests received on the website in compliance with its code of ethics and in the interests of its client.
The lawyer is bound to an obligation of means.
Payment terms
The payment of services offered on the website is only by credit card.
The service will be delivered in its entirety from the collection.
Shipping and delivery times
The lawyer undertakes to contact the client in order to receive the necessary information for the personalized consultation within a reasonable period of between 48 hours and 8 days.
If this contact has not taken place within a period of 8 days from the date of payment, and if this overrun is not related to a case of force majeure, the Customer may proceed to the resolution of the sale, sending by registered mail with acknowledgment of receipt to the following address: 7 rue Claude Chahu, 75116 Paris. The sums paid by the Customer will then be fully refunded without any file opening fee.
Retraction period applicable only for individuals: exchange or return
Clients, non-professional individuals, benefit from a withdrawal period of fourteen days from the delivery of their order to contest and request reimbursement without penalty in accordance with the Hamon law n ° 2014-344 of March 17, 2014.
Nevertheless, this law does not apply in the following cases:
– For services whose execution started with the agreement of the consumer before the end of the withdrawal period, which is the case for the online legal services of Cabinet GOLDWIN, because the contact with the Lawyer is the beginning of the service before any payment, and the payment of the service implies acceptance of these terms and conditions of sale specifying the express exclusion of the withdrawal period for this type of service.
Lawyer fees for the services offered
The Lawyer recalls that this site and all its services are strictly subject to the respect of the ethics of the profession of Lawyer.
The firm GOLDWIN offers packages and subscriptions whose prices are those listed on the website.
Thus, the amount of fees is that of use and application consistent with the profession in the same field.
Ethical provisions for distance legal services
Article 6.6.4.1 Lawyer creating a legal services website:
« The lawyer who creates, exploits or participates mainly, alone or with colleagues, in the creation and operation of a legal services website may freely collect any remuneration from the clients of this site; it may, where appropriate, collect it via one of the financial institutions ensuring the security of online payments, provided that the identification of the customer also remains possible on this occasion ».
